A Supreme Court judge today rejected claims made by a Pakistani-born man (known as MSK for some reason) that his cultural Muslim upbringing made him believe that he had the right to rape girls he considered promiscuous.
MSK was already serving 22 years for gang-rape when the judge added a further 5 years to his sentence for good measure. He will not be eligible for parole for 22 years.
The victim, Tegan Wagner from Sydney, now 18 but 14 at the time of the rape, waived her right to anonymity and gave the defendant the bird on his exit from court, adding
"See ya boys. Have a nice life in prison. Fuck you and go to hell, mate".
God Bless her.
At a hearing, MSK had argued that Ms Wagoner had come to his house unchaperoned, had been drinking and had not worn a headscarf. This led him and his brother to believe that she was "promiscuous". The defence actually used the argument that because of his strict Muslim upbringing in a provincial Pakistani town, he believed he had the right to rape her.
If this is the case, what exactly does this say about Islam and the way Muslim boys are being brought up?

The four K brothers are the children of a Sydney GP. They had grown up in Pakistan and were brought to Sydney in 2000. The good doctor lied on oath to provide his doting cherubs with an alibi. He was facing perjury charges at the time of his death in Nov 2006.
The fifth rapist, Ram Shrestha, a Nepalese immigrant and friend of the brothers, hung himself in his prison cell after he was found guilty.
The brothers are now serving sentences ranging from 15 to 24 years.
The brothers' lawyer who used the defence of 'cultural differences' was reprimanded by the judge for using this racist argument.
On leaving the court Tegan stated,
"This wasn't about culture; this was about abuse against women."

ReplyDeleteOver here, they get classified as 'violent sexual predators' and spend the rest of their lives in lockup.
In the UK, they would have probably served 5-7 years. I was pretty impressed by the 22 year minimum.

I've got to agree with Kieran. Most Muslims would be horrified with these criminals trying to use Islam as an excuse. Islam does not teach that women are an inferior species. Why are you asking Kieran "..do you also believe that a man has the right to four wives and that a women's place is in the home?" It's not relevant to anything he said or the issue in question. Tegan is an incredibly brave girl and an inspiration to us all.

ReplyDeleteYou are correct in saying that most Muslims would indeed be horrified at these criminals using Islam as an excuse.
However, Islam most certainly does teach that women are an inferior species. In traditional Islamic societies, women are barred from higher education, are barred from walking alone in public (they have to be escorted by members of their family) and are prohibited from voting. They have very few rights.
It is this patriarchal culture that inevitably leads young Australian-born Muslims to believe that women are the inferior species.
Tegan Wagner is the bravest young woman in Australia. Never mind Islam, she had the Australian Christian based judicial system against her as well. Many Australian women who have been raped, decline to report it to the police, because they know how they would be treated in court. Women need to be consecrated virgins for a slim chance of getting a fair hearing in any Australian court. We are either “Damned whores or Gods police”. Tegan Wagner found the courage to shed anonymity and face both the rapists and their legal attack dogs. All power to her.
